Demandan legalmente a la Cámara de Comercio y Producción Santo Domingo por violación artículos 40, 42, 44 y 148 de la Constitución de la República Dominicana y 3 de ley 107-13 sobre los Derechos de las Personas en sus Relaciones con la Administración y de Procedimiento Administrativo.
El abogado Freddy Enrique Ureña Polanco demando a la Cámara de Comercio y Producción de Santo Domingo y a su presidente Manuel Luna por revelar información confidencial y atentar contra la libertad y la protección de datos personales y muy especialmente por dañar su reputación profesional.
El abogado y ciudadano, cumpliendo con tramites propios del ejercicio de la abogacía, solicitó información de la razón social Petróleo Nacionales S.A.S., (PETRONAN) por ante la Cámara de Comercio y Producción de Santo Domingo pero para su sorpresa ese mismo día de la solicitud la directora legal de Petróleo Nacionales S.A.S., (PETRONAN) inmediatamente le mostro la misma solicitud enviada por él a la Cámara de Comercio en donde se revelan sus datos personales, en ese mismo sentido la directora Legal de PETRONAN de forma intimidante le envió un mensaje vía WhatsApp expresando si era él que había solicitado dicha información. Con esta acción se evidencia una posible complicidad y actuaciones ilegales en el ejercicio de manejo de información, tramites de datos y documentos por parte de la Cámara de Comercio y Producción de Santo Domingo.
El registro Mercantil es público, por lo tanto todo ciudadano tiene derecho a tener acceso a la información pública y de hecho esta información se paga pues hay tasas establecidas por la Cámara de Comercio y Producción de Santo Domingo para otorgar dichas informaciones siempre y cuando que no haya desmedro de violaciones a sus derechos fundamentales consagrados por la Constitución Dominicana.
Los datos personales de los ciudadanos dominicanos están protegidos por la Constitución Dominicana en los artículos 40, 42 y 44, los cuales fueron violados por la Cámara de Comercio y Producción de Santo Domingo al suministrarle a la razón social Petróleo Nacionales S.A.S., (PETRONAN) los datos del demandante.
El presidente de la razón social Petróleos Nacionales S.A.S., (PETRONAN), es el señor Cesar Félix Ramos Ovalles, quien se encuentra imputado en el sonado caso Coral 5G, e imaginamos que el señor Freddy Enrique Ureña Polanco, fuera un periodista y estuviere realizando una investigación de la empresa por asuntos de corrupción, que riesgo estuviera corriendo tanto el cómo su familia, por el solo hecho de ejercer su carrera libre y voluntariamente y la Cámara de Comercio y Producción de Santo Domingo al revelar sus datos lo ha colocado en una situación incómoda exponiendo sus datos de manera flagrante e ilegal.
